PUBLIC NOTICE OF SETTLEMENT AGREEMENT NO. UT-118-02 PURPOSE OF PUBLIC NOTICE

This notice is to declare that the State of Utah has reached a settlement agreement with Savage Services Corporation. This Public Notice is issued pursuant to Utah Administrative Code R317- 8-1.9, to provide opportunity for public comment on the proposed settlement of a Notice of Violation. The proposed order is for the purpose of resolving alleged violations of Utah Code Annotated 19-5 (Water Quality Act), and is a resolution of enforcement proceedings brought against Savage Services Corporation.

PUBLIC COMMENTS

Public comments are invited any time prior to close of business August 31, 2018. Comments may be directed to the Department of Environmental Quality, Division of Water Quality, 195 North 1950 West, P.O. Box 144870, Salt Lake City, Utah 84114-4870.

The settlement agreement is available for public review under “Public Notices” at https://deq.utah.gov/public-notices-archive/water-quality-public-notices. MEETING

Notice is hereby given that the MIDWAY CITY PLANNING COMMISSION will hold their regular meeting on Wednesday, August 15, 2018 at 7 p.m. in the Midway Community Center, located at 160 West Main Street, Midway, Utah, to consider the following items:

1. Berg Engineering, agent for Kraig R. Ford Trust, is requesting a preliminary/final approval for a small-scale subdivision. The proposal is 2.12 acres in size and will contain two lots. The property is located at 115 West 970 South and is in the R-1-22 zone.

2. David Perez-Medina is applying for a Conditional Use Permit for an alcohol dispensing establishment. He is petitioning for the ability to serve beer and wine at Lola’s Street Kitchen located at 24 East Main Street. The property is 0.07 acres in size and is located the C-2 zone.

3. Paul Watson, agent for DPW Heber Inc., is requesting Master Plan Approval for the Saddle Creek Ranch Subdivision. The proposal is a large-scale subdivision that is 32 acres in size that would be developed in four phases containing a total of 36 lots. The property is located at 970 South 250 West and is in the R-1-22 zone.

4. Midway City is proposing a code text amendment of Section 16.13.39: Off-Street Parking and Loading. The proposed code will increase the number of parking stalls required for commercial developments.

NOTICE

NOTICE is hereby given that the WASATCH COUNTY COUNCIL will hold a Public Hearing on August 15, 2018 at 6 p.m. in the Wasatch County Council Chambers to hear the following items advanced to the County Council:

1. Discussion and possible action on a request from Kurt Krieg, on behalf of BLX Mayflower, LLC, for master plan, density determination and constraints analysis for the Mayflower Mountain Resort project. The proposal consists of a potential density on the Mining Influence Zone of up to 710 ERUs, along with the existing JSPA target density of 1,024 ERU’s within the +/- 940 acres for a proposed total density of 1,970 ERU’s. The Mayflower Mountain Resort project is located on the west side of Mayflower Mine Road, south west of the U.S. Highway 40/Deer Hollow Road (State Route 319 – Exit 8) interchange and more specifically in Section 25 of Township 2 South, Range 4 East in the JSPA (Jordanelle Specially Planned Area). zone.

2. Jack Johnson Consulting, representative for SkyRidge Development LLC., is requesting preliminary approval for the property formerly referred to as “Mayflower Lakeside North” and now referred to as the “SkyRidge” development. The proposal consists of 503 ERUs on 678 acres and is located on the east side of Highway 40 between the north arm of the Jordanelle and Highway 40. The proposal is more specifically located in Section 13 of Township 2 South, Range 5 East in the JSPA (Jordanelle Specially Planned Area).

There likely will be additional matters the Council considers at this meeting which will be included in subsequent notices. The purpose of this notice is to provide two weeks published notice for these two public hearing items.

1. Jeffrey Butterworth, representative for Storied Deer Valley LLC., is requesting preliminary approval for Tuhaye Lone Peak which is a large scale development consisting of 31 lots. The proposal is located at 10105 N. Tuhaye Park Drive in Section 28, Township 2 South, Range 5 East, in the JBOZ (Jordanelle Basin Overlay Zone).

2. Jeffrey Butterworth, representative for Storied Deer Valley LLC., is requesting a plat vacate for Moondance. The proposal is to vacate the plat and subsequently adopt the amended plat removing 9 lots. The project is located in Sections 27 and 28, Township 2 South, Range 5 East, in the JBOZ (Jordanelle Basin Overlay Zone).

3. Jeffrey Butterworth, representative for Storied Deer Valley LLC., is requesting a plat amendment to the Moondance Plat to remove 9 total lots and create 3.39 acres of common area for a park in the center area of the plat. The property is located in Sections 27 and 28 of Township 2 South, Range 5 East in the JBOZ (Jordanelle Basin Overlay Zone).

4. Summit Engineering, representative for Jay and Ellen Eckersley, is requesting a plat amendment to the Farms at Tate Lane Subdivision amending the boundary line between lots 7 and 8. The properties are located at 1441 and 1475 South Tate Court in Section 10 of Township 4 South, Range 4 East in the RA-1 (Residential Agricultural 1-Acre) Zone.

5. Matthew Idema, representative for Clayton Properties Group II, LLC., is requesting a plat amendment to Jordanelle Ridge Plat A 4th Amended. The proposal is to remove a plat note for lots A-73 through A-83. The current note states that they are cottage lots that are HOA maintained and that no fences are allowed. The applicant is requesting that the note be removed so that the homes are maintained by the property owner and that fences can be allowed. The plat amendment is also proposed to include a reduction of a PUE between lots 73 and 74 from the current PUE of 20’ to 15’.
