1. Discussion and possible motion on Ordinance 18-01. The ordinance amends Chapter 4 of the Wasatch County General Plan entitled Land Use. The amendments are more specifically for the Central Planning Area by adding language on Page 168 and the Southern Planning Area adding language to Page 192. The additions provide the language to establish a boundary between the Central Planning Area and the Southern Planning Area. Continued from the February 7, 2018 meeting.

2. Megan Probst is requesting a rezone of 20.50 acres from A-20 (Agricultural 20-acre lots) to RA-5 (Residential Agricultural 5-acre lots). Wasatch County School District – Asphalt Maintenance

Notice is hereby given that the MIDWAY CITY PLANNING COMMISSION will hold a meeting on Wednesday, April 18, 2018 at 7 p.m. in the Midway Community Center, located at 160 West Main Street, Midway, Utah, to consider the following items:

1. Midway City is proposing a Code Text Amendment of Midway City’s Land Use Code of Title 16.13.10 regarding restrictions for transmission lines. The City would like to adopt restrictions that would govern the height and other items for transmission lines built in the City.

2. Jeremy Clark, agent for Snake Creek Partners LLC, is requesting a Plat Amendment of the Lodges at Snake Creek. The current plat contains 24 units, spread between three buildings, that have not yet been constructed. The amendment would reconfigure the 24 units into a mix of four-plex and duplex townhome style buildings. The property is located at the northwest corner of the intersection of Cari Lane and Pine Canyon Road and is located in the R-1-15 zone.

3. Karl Probst is applying for a Conditional Use Permit for an alcohol dispensing establishment. The restaurant will be called The Corner Restaurant and is located at 195 West Main Street. The property is 0.28 acres in size and is located the C-2 zone.

4. Luster Development, agent for Tom and Linda Whitaker, is proposing preliminary approval of the Whitaker Farm Subdivision. The proposal consists of 50 lots on 80 acres and contains 20 acres of open space. The property is located at 455 North River Road and is in the RA-1-43 zone.

NOTICE OF TRUSTEE’S SALE

On the 30th day of April, 2018, at the hour of 11:00 a.m., of said day, on the front steps of the Main Entrance of the Wasatch County Courthouse, 1361 South Highway 40, Heber City, Utah, Daniel J. Torkelson, as Trustee, will sell at public auction, to the highest bidder, for cash, in lawful money of the United States, all payable at the time of sale, the following described property located in Heber City, Wasatch County, Utah, and more particularly described as follows:

The following described property being proposed plat of Beaufontaine Phase 8. A Parcel of Land Located in the Northeast Quarter of Section 4, Township 4 South, Range 5 East, Salt Lake Base and Meridian, being more particularly described as follows: Beginning at a point located North 89°48’22” East 951.57 feet and South 1203.72 feet from the North Quarter Corner of Section 4, Township 4 South, Range 5 East, Salt Lake Base and Meridian; and running thence North 89°57’27” East 396.78 feet; thence South 00°00’59” East 432.39 feet; thence North 90°00’00” West 96.42 feet; thence North 0°00’59” West 21.04 feet to a point of curvature with a 110.00 foot radius curve to the left; thence continuing 115.62 feet along the arc of said curve through a central angle of 60°13’31” (Chord Bears North 30°07’45” West 110.37 feet); thence North 60°14’30” West 149.20 feet to a point on the arc of a 291.59 foot radius curve to the right; thence continuing 231.90 feet along the arc of said curve through a central angle of 45°33’58” (Chord Bears North 29°43’24” West 225.83 feet) to a point of curvature with a 745.09 foot radius curve to the right; thence continuing 45.57 feet along the arc of said curve through a central angle of 03°30’15” (Chord Bears North 04°30’46” West 45.56 feet) to the point of beginning.

Together with all permits, contracts, contract rights, licenses, construction contracts, architectural contracts, plans and specifications, governmental permits, fixtures, equipment, boilers, building materials, appliances, irrigation systems, goods, machinery, tools, office equipment, supplies, furnishings, furniture, inventory, accounts, instruments, documents, intangibles, chattel paper, general intangibles, and the proceeds and products of any of the foregoing, now or hereafter located on, or used or intended to be used in connection with, the real property described above, the construction of improvements on the real property described above, or the occupancy or use of the real property described above.

Said sale will be made without covenant or warranty regarding title, possession or encumbrances to satisfy the obligation secured by and pursuant to the power of sale conferred in the Deed of Trust, Assignment of Rents, Security Agreement and Fixture Filing executed by Beaufontaine Partners, LLC, a Utah limited liability company, as Trustor, in which Blackstone Capital, LLC, a Utah limited liability company, was named as Beneficiary, which was filed on October 31, 2016, as Entry No. 430759, in Book 1174 at Page 520, in the Records of the County Recorder of Wasatch County, Utah.

The current beneficiary of the Trust Deed is Blackstone Capital, LLC, a Utah limited liability company. The record owner of the property as of the recording of the Notice of Default was, and currently is, Beaufontaine Partners, LLC, a Utah limited liability company.

Bidders must be prepared to tender to the Trustee a $25,000.00 cashier’s check at the sale and a cashier’s check for the balance of the purchase price by 5:00 p.m., Mountain Time, on the date of the sale.
